On June 15th, Premier Li Keqiang presided over an executive meeting of the State Council and decided to declare the invalidation of a batch of policy documents that are inconsistent with current laws and regulations, not conducive to business and entrepreneurship, and not suitable for the needs of economic and social development; Deploy and clean up the security deposit in the field of engineering construction, reduce enterprise costs, and create a fair competitive environment.
Core content of the meeting
1、 Clean up various types of security deposits that construction enterprises need to pay in engineering construction.
Except for retaining the four types of guarantees for migrant worker wages, bidding, performance, and project quality established in accordance with laws and regulations, all other guarantees shall be cancelled. The collected amount will be refunded before the end of this year.
2、 Without the approval of the State Council, no region or department shall establish new margin projects in the field of engineering construction.
Promote the disclosure of margin information and establish a reporting and investigation mechanism.
3、 Change the method of deposit payment.
Construction companies can pay the retained deposit through a bank guarantee. The receiving unit shall strictly return the goods on time in accordance with regulations.
4、 We need to standardize margin management.
The upper limit of the reserved proportion for the engineering quality guarantee deposit shall not exceed 5% of the total settlement amount of the engineering price; If the performance bond has been paid before the completion of the engineering project, the construction unit shall not reserve the engineering quality bond at the same time. Differentiated payment methods will be implemented for the salary deposit of migrant workers. Enterprises that have not experienced wage arrears within a certain period of time can be exempted or exempted, and the payment ratio for enterprises with wage arrears should be increased.
